The Federal Rules of Civil Procedure (FRCP) are a body of rules and regulations, intended to govern procedures for civil suits in the United States District Courts. They apply to all companies who may be involved in such a suit, at one point or another.
On December 1, 2006, a number of important revisions to the FRCP went into effect. These include a regulation that organizations must manage their electronically stored information (ESI) in such a way that it can be produced in a timely and complete manner when necessary, such as during legal proceedings.
All companies that could potentially be involved in civil litigation now must structure their message retention policies around these regulations. That includes email and electronic (mobile) messaging, as these pieces of regulated communication are becoming more and more common forms of admissible evidence during the legal discovery process.
